We welcome client referrals from other attorneys and pay referral fees in accordance with The Rules of Professional Conduct of the State Bar of California. If you are an attorney and have a client who has a mortgage-related issue, please call us.
We also enjoy working as co-counsel on mortgage law cases. We offer advice on writing effective complaints based on both federal lending laws and the applicable consumer laws of California. FOR OUR CLIENTS
We consider a referral from one of our past or current clients the highest compliment we can get. If you are, or have been one of our clients, rest assured we will provide your friends and family with that same professional service you enjoyed.
OTHER REFERRALS
The Rules prohibit referral fees from being paid to non-lawyers. Thus, we will not pay any referral fees to non-attorneys. We receive dozens of calls every day from brokers, loan officers, escrow officers, processors, underwriters, and other people telling us they want to send us clients and then asking how much we will pay. Before you call, understand we will give you the same answer that we gave those before you, "We will thank you for every referral you give us, and we will take care of that referred client to the best of our abilities, but we will not pay you any referral fee of any kind."
One word of caution to those people offering credit counseling services, foreclosure prevention services, short sale counseling, or some other similar service... familiarize yourself with the Foreclosure Consultant Act and other similar laws and take care not to give legal advice.
LOAN MODIFICATION DISCLAIMER
Our loan modification services have expanded, and we have many clients who need help renegotiating their current loan with their lender. We have noticed that there are many other organizations offering similar services. Some of these other organizations are attorneys, and some are not. Some of them are legitimate and some are not. Because we want our clients and potential clients to understand understand what services we offer and to have realistic expectations of us, we have posted our disclaimer here.
Many reputable, and a few not so reputable, credit counseling associations, "foreclosure specialists," "loan modification" agencies, and other such organizations have referred their clients to us for loan modifications or other help with an unaffordable loan. We welcome those referrals, but want our current clients and potential clients to know the following:
1. There is no way to guaranty a loan modification, short sale, deed-in-lieu of foreclosure, or any other desired result. Any lawyer, firm or organization that does make such a guarantee should be heavily scrutinized, if not doubted. The only guarantee we make is that we do our best to provide the services you hired us to perform.
2. We are a law firm. As such we are not allowed to pay referral fees to non-lawyers. We are not allowed to engage in any fee sharing arrangement with non-lawyers. We receive referrals from several sources. Unless that source is a lawyer, we do not pay any of these sources, and the sources do not in any way speak for us or on our behalf. Those who refer us clients are independent of Fransen & Molinaro, LLP and may or may not be abiding by all relevant laws. Our concern is solely for our client, regardless of how our client comes to be our client.
3. We do not offer refunds. We provide zealous representation to those who retain our services. We strive to accomplish the goals as understood by us from our clients. If we do not achieve the stated goals of the client, we do not refund any portion of fees paid.
4. We are licensed in the State of California. We do not practice law in any other state. Any information garnered by someone from our website, published articles, or other sources who is not a resident of California should understand we are not your lawyers. |
